Tax Structure Note: ESPA is an employer-sponsored medical benefits program, not health insurance. It uses two separate employer medical benefits. Eligible employees may use a Section 125 election to satisfy their share of the Employer-Sponsored Medical Benefit, a defined set of qualifying medical services; IRC §106 addresses the tax treatment of that employer-provided benefit. Separately, the employer funds a Self-Insured Medical Reimbursement Plan, or SIMRP, which may reimburse eligible §213(d) medical expenses under §105(b), subject to Plan terms and applicable limits. The Section 125 election does not fund the SIMRP reimbursement.
